1. Acceptance of Terms
By accessing or using the GagaTrend service, website, mobile application, or related features (collectively, the "Service"), you accept and agree to be bound by these Terms of Service.
If you do not agree to these Terms, you must not use the Service.
2. User Account
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to provide accurate information when creating or using your account and to keep your account information up to date.
You may not share your account with another person or use another person's account without permission.
3. Privacy Policy
Your use of GagaTrend is also governed by our Privacy Policy. The Privacy Policy explains how GagaTrend collects, uses, stores, protects, and shares personal data in connection with the Service.
By using the Service, you acknowledge that you have read and understood our Privacy Policy.
4. User Content
The Service allows users to create, upload, publish, display, share, comment on, or otherwise make available content, including stylizations, avatar-related content, profile information, comments, messages, images, and other materials ("User Content").
You retain ownership of the rights that you hold in your User Content.
By uploading, creating, or using User Content through the Service, you grant GagaTrend a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, display, distribute, modify, adapt, resize, crop, format, and make available such User Content as necessary to operate, provide, secure, improve, and moderate the Service.
If you choose to publish User Content as public, you grant GagaTrend the additional rights described in the "Public User Content and Organic Promotional Use" section of these Terms.
You represent and warrant that you have all necessary rights, permissions, and consents to upload, create, publish, or share your User Content through the Service.
5. Public User Content and Organic Promotional Use
Some features of GagaTrend allow users to publish stylizations, avatars, profile content, comments, and other materials publicly within the Service ("Public User Content").
When you choose to publish User Content as public, you understand and agree that such content may be visible to other users of the Service and may also be displayed outside the logged-in areas of the Service, including on public websites, public galleries, ranking pages, landing pages, editorial pages, curated collections, and other GagaTrend-operated channels.
By publishing User Content as public, you grant GagaTrend a worldwide, non-exclusive, royalty-free license to host, store, reproduce, copy, display, publicly perform, distribute, adapt, resize, crop, format, edit for technical or presentation purposes, publish, feature, promote, and otherwise use such Public User Content in connection with operating, improving, presenting, and organically promoting GagaTrend and the Service.
This license includes the right for GagaTrend to display Public User Content in public rankings, curated selections, editorial collections, "top stylizations" lists, public galleries, newsletters, websites, landing pages, presentations, organic social media posts, and other non-paid promotional materials related to GagaTrend.
This license also includes the right to use your public username, display name, profile photo, and other public profile information in connection with the display, promotion, or presentation of your Public User Content.
GagaTrend will not sell your Public User Content as a standalone asset to third parties.
GagaTrend will not use Public User Content that prominently features a user's recognizable face or likeness in paid advertising campaigns without requesting additional permission where required by applicable law.
If you delete Public User Content or change its status from public to private, GagaTrend will stop displaying it publicly within the Service within a reasonable time. However, you understand that previously published organic social media posts, editorial materials, cached pages, backups, screenshots, reposts, or materials already distributed may remain available where immediate removal is not technically or commercially reasonable.
You represent and warrant that you have all rights, permissions, and consents necessary to publish the User Content and to grant GagaTrend the rights described in this section, including any rights related to images, likeness, clothing, products, text, or other materials included in the User Content.
6. AI-Generated Content and Data Processing
GagaTrend provides AI-powered features, including avatar generation and virtual try-on / stylization generation.
When you only browse the app, view products, view other users' stylizations, use the catalog, or use the feed, GagaTrend does not send your photo, avatar, or personal image data to third-party AI providers for generation purposes.
If you choose to use avatar generation, GagaTrend will process the photo that you upload or capture in the app. This photo may include your face, body image, posture photo, and related technical data required to complete the request.
If you choose to use virtual try-on or stylization generation, GagaTrend will process your selected avatar, selected clothing/product images, and related technical request data required to generate the result.
For these specific AI generation purposes only, GagaTrend may share the above data with third-party AI service providers, including Google Vertex AI and OpenAI. These providers are used only to process your request and return the generated avatar or virtual try-on / stylization result.
GagaTrend does not share your uploaded photo, avatar, virtual try-on data, or stylization generation data with third-party AI providers for advertising or marketing purposes.
Before any photo, avatar, selected product image, or virtual try-on data is sent to a third-party AI service provider, the app will display an in-app notice explaining what data will be sent, who it may be sent to, and the purpose of the processing. GagaTrend will request your permission before sending this data.
If you do not give permission, the relevant AI generation feature will not be performed.
GagaTrend requires third-party service providers that process personal data on its behalf to provide appropriate safeguards and the same or equivalent level of protection required for the data processed through the Service.
AI-generated results may vary and may not always be accurate, realistic, complete, or suitable for every purpose. GagaTrend does not guarantee that AI-generated avatars or stylizations will match your expectations or the exact appearance of any real product.
7. User-Generated Content and Community Safety
GagaTrend includes user-generated content features, including public stylizations, user profiles, comments, messages, shared content, and other materials created or shared by users.
GagaTrend has zero tolerance for objectionable content and abusive users.
You may not upload, publish, send, display, promote, or share any content that is illegal, hateful, harassing, threatening, abusive, sexually explicit, discriminatory, violent, defamatory, misleading, spam, advertising, or otherwise inappropriate for the Service.
You may not abuse, harass, threaten, impersonate, exploit, intimidate, bully, or target other users.
You may not use the Service to publish or distribute content that infringes intellectual property rights, privacy rights, image rights, or any other rights of another person or entity.
GagaTrend may review, filter, hide, remove, moderate, restrict, or block any User Content that violates these Terms, our community safety rules, applicable law, or the intended purpose of the Service.
Users can report objectionable content and abusive behavior using the in-app reporting tools.
Users can block abusive users in the app. When a user is blocked, content from the blocked user will be removed from the blocking user's feed immediately where technically possible, and GagaTrend may be notified for moderation review.
GagaTrend may suspend, restrict, or permanently terminate accounts that publish objectionable content, engage in abusive behavior, repeatedly violate these Terms, or create risk for other users or the Service.

8. Reporting, Blocking, and Moderation
The Service provides tools that allow users to report content, report users, and block users.
Reports may be reviewed by GagaTrend for moderation, safety, fraud prevention, abuse prevention, and enforcement of these Terms.
If you report content or a user, GagaTrend may process information related to the report, including the reported content, the reported user's account information, your account information, the reason for the report, and any additional message or context that you provide.
If you block a user, GagaTrend may use this information to remove that user's content from your feed, limit interactions between you and the blocked user, and notify GagaTrend for moderation review where appropriate.
GagaTrend may take moderation actions at its discretion, including hiding content, removing content, restricting distribution, blocking content, suspending accounts, terminating accounts, or taking other steps necessary to protect users and the Service.
9. Prohibited Uses
You may not use the Service for any illegal purpose or in violation of any local, state, national, or international law.
You may not use the Service to:
- Upload, generate, publish, or distribute illegal, harmful, abusive, or objectionable content.
- Harass, threaten, impersonate, exploit, or abuse other users.
- Interfere with or disrupt the security, operation, or integrity of the Service.
- Attempt to gain unauthorized access to accounts, systems, data, or infrastructure.
- Use automated systems, bots, scraping tools, or similar technologies without authorization.
- Reverse engineer, copy, modify, or misuse any part of the Service except as permitted by law.
- Use the Service for spam, unauthorized advertising, or deceptive activity.
- Upload content that infringes the rights of others, including intellectual property or privacy rights.
10. Product and Third-Party Content
The Service may display products, product images, links, descriptions, or other information provided by third parties, retailers, brands, or external systems.
GagaTrend is not responsible for the availability, pricing, quality, delivery, or accuracy of products offered by third-party retailers or external websites.
If the Service redirects you to a third-party website or store, your use of that website or store may be governed by that third party's own terms and privacy policy.
11. Account Suspension and Termination
GagaTrend may suspend, restrict, or terminate your account if you violate these Terms, misuse the Service, create risk for other users, publish objectionable content, engage in abusive behavior, or if we are required to do so by law.
You may stop using the Service at any time. You may also request account deletion where this option is available under applicable law or within the Service.
12. Limitation of Liability
To the maximum extent permitted by applicable law, GagaTrend shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages resulting from your access to or use of the Service.
The Service is provided on an "as is" and "as available" basis. GagaTrend does not guarantee that the Service will be uninterrupted, error-free, secure, or free of defects.
13. Changes to Terms
We reserve the right to modify these Terms at any time.
We will notify users of material changes by posting the updated Terms within the Service or by other reasonable means.
Continued use of the Service after the updated Terms become effective means that you accept the updated Terms.
