Gaga Trend Online Store Terms and Conditions

These Terms and Conditions define the rules for concluding sales agreements via the Gaga Trend Online Store, including key information about the Seller, the Store, and the rights of Consumers. Provisions concerning Privileged Entrepreneurs apply to agreements concluded on or after January 1, 2021.

§ 1 Definitions

  • Business Days – days from Monday to Friday excluding public holidays.
  • Consumer – as defined under the Polish Civil Code.
  • Account – a free-of-charge feature of the Store, regulated by a separate set of terms, allowing Buyers to create an individual account.
  • Buyer – any entity making a purchase in the Store.
  • Privileged Buyer – a Consumer or Privileged Entrepreneur.
  • Privileged Entrepreneur – a natural person entering into a contract directly related to their business activity, but not of a professional nature (valid from January 1, 2021).
  • Pickup Point – located at [insert pickup location if any].
  • Terms – this document.
  • Store – the online store operated by Gaga Trend at [insert domain].
  • Seller – Gaga Trend Sp. z o.o., registered in Poland, [insert full registration details].

§ 3 Technical Requirements

  • Internet-enabled device
  • Browser supporting JavaScript and cookies
  • Active email account (for placing orders)

§ 4 Shopping Process

  • Product prices shown are final, including VAT.
  • Total order cost includes product price and delivery (if applicable).
  • Add products to the cart, choose delivery and payment options, enter necessary data.
  • Contract is concluded once Buyer confirms the order and accepts the Terms.
  • Buyers may register for an Account or shop without registration.

§ 5 Payments

Payment methods (depending on Buyer choice and availability):

  • Bank transfer
  • Debit/credit cards (Visa, Mastercard, Maestro, etc.)
  • Online payment platforms
  • Cash on delivery (if available)

If a refund is required for a card payment, it will be issued to the cardholder's bank account. Orders with advance payment must be paid within 1 Business Day. Some payment options are only available immediately after order placement.

§ 6 Order Fulfillment

  • Seller delivers goods free from defects.
  • Fulfillment time is stated in the Store.
  • Prepaid orders are processed upon payment.
  • If products with different delivery times are ordered, dispatch follows the longest timeframe.
  • Delivery available to EU countries listed at checkout.
  • Delivery via courier or parcel locker; optional in-person pickup (if offered).

§ 7 Right of Withdrawal

  • Privileged Buyers may withdraw from the contract within 14 days without giving a reason.
  • Deadline is counted from receiving the goods.
  • To withdraw, submit a statement via email or letter.
  • Use of withdrawal form is optional.

Effects of Withdrawal:
- Full refund including basic shipping within 14 days.
- Refund via original payment method unless agreed otherwise.
- Seller may withhold refund until goods are returned or proof provided.
- Return shipping at Buyer's expense unless stated otherwise.

§ 8 Exceptions to Withdrawal Right

  • Custom-made products
  • Perishable goods
  • Sealed items unreturnable once opened for health/hygiene reasons
  • Items inseparably mixed with others after delivery
  • Audio/video recordings or software unsealed after delivery
  • Periodicals (except subscriptions)
  • Products affected by market fluctuations beyond Seller’s control

§ 9 Complaints

  • Complaints under warranty or guarantee if applicable.
  • Privileged Buyers may demand repair, replacement, price reduction, or withdrawal.
  • Warranty applies for defects within 2 years.
  • Non-Privileged Entrepreneurs must inspect goods promptly.
  • Complaints sent to contact in § 2; return shipping covered for Privileged Buyers.
  • Resolved within 14 days.

§ 10 Personal Data

§ 11 Final Provisions

  • Illegal content is prohibited.
  • Each order is a separate contract.
  • Contracts governed by Polish law.
  • Disputes with non-Privileged Buyers resolved in Seller's jurisdiction.
