§ 1. General Provisions
These Terms of Use (“Terms”) define the rules for using the GagaTrend website available at https://gagatrend.com and the GagaTrend mobile application (collectively referred to as the “Service”).
The operator of the Service is GagaTrend (“Operator”).
By accessing or using the Service, including creating an account, the User enters into an agreement for the provision of electronic services and accepts these Terms in full.
These Terms define in particular the rights and obligations of Users, the rules for publishing content, using artificial intelligence features, and the liability of the parties.
§ 2. Definitions
- User – an individual using the Service.
- Account – an individual user account created within the Service.
- User Content – any content published, uploaded, generated, or shared by the User within the Service.
- AI-Generated Content – content created using artificial intelligence features available within the Service.
- Services – functionalities offered within the Service.
§ 3. Eligibility
The Service is intended for individuals who are at least 13 years old or older if required by applicable law in the User’s country of residence.
By using the Service, the User represents that they have the legal capacity to enter into a binding agreement.
§ 4. Account and Security
Creating an Account is required to access the full functionality of the Service.
The User must provide accurate and truthful information during registration and keep such information up to date.
The User is fully responsible for maintaining the security of their Account.
- The password and login credentials must remain confidential.
- Sharing an Account with third parties is strictly prohibited.
- The User is responsible for all activities conducted through their Account.
The Operator shall not be liable for any loss or damage resulting from unauthorized access caused by the User’s failure to safeguard login credentials.
§ 5. Responsibility for Content
The User bears sole and full responsibility for User Content.
The Operator does not assume responsibility for content published by Users, including its legality, compliance with third-party rights, or consequences resulting from its publication.
The User represents and warrants that they have all necessary rights, permissions, and consents required to publish their User Content.
§ 6. Prohibited Content
The following content is strictly prohibited within the Service:
- Pornographic or sexually explicit content, including sexualized nudity.
- Nude or partially nude images, including self-images, that violate community safety standards.
- Content depicting violence, harassment, hate speech, or threats.
- Content infringing copyrights, trademarks, image rights, or other intellectual property rights.
- Personal data of third parties without proper authorization.
- Advertisements, commercial promotions, affiliate links, or external service promotions without Operator’s consent.
- Spam or automated activity.
- Any content that violates applicable laws.
§ 7. Use of Artificial Intelligence Features
The User agrees to use AI-based content generation tools solely in compliance with applicable law and these Terms.
- Attempting to bypass system safeguards is prohibited.
- Generating pornographic or illegal material is prohibited.
- Creating deepfakes or manipulated media that infringe the rights of others is prohibited.
§ 8. License to User Content
The User retains ownership of their User Content. However, by publishing content within the Service, the User grants the Operator a non-exclusive, royalty-free, worldwide license to:
- host and store the content,
- display and distribute it within the Service,
- reproduce and promote it in connection with the Service,
- use it for marketing and promotional purposes of the Service.
This license remains valid for the duration of content availability within the Service and to the extent necessary for the operation and promotion of the Service.
§ 9. Moderation and Enforcement
The Operator reserves the right to remove content that violates these Terms and to take action against Users who breach the rules.
- Content removal,
- Restriction of account functionality,
- Temporary suspension,
- Permanent account termination.
§ 10. Account Termination and Re-Registration Ban
In cases of serious violations, including but not limited to pornography, illegal content, or severe infringement of third-party rights, the Operator may permanently terminate the User’s Account.
The Operator reserves the right to block re-registration using the same email address, phone number, or other technical identifiers.
§ 11. Limitation of Liability
The Service is provided on an “as is” and “as available” basis.
The Operator does not guarantee uninterrupted or error-free operation.
The Operator shall not be liable for:
- User-generated content,
- damages resulting from use or inability to use the Service,
- data loss caused by circumstances beyond the Operator’s control.
§ 12. Indemnification
The User agrees to indemnify and hold harmless the Operator from any claims, damages, losses, or legal costs arising from the User’s violation of these Terms or applicable law.
§ 13. Amendments
The Operator reserves the right to amend these Terms. Changes take effect upon publication within the Service.
§ 14. Governing Law
These Terms shall be governed by the law applicable to the Operator’s registered office. Any disputes shall be resolved by the competent court of jurisdiction.
